Rear End Collision - $595,500.00
Liability Facts: Clients 2016 Toyota “Corolla” was rear ended by a 2012 Ford “F350" pickup truck on I-85 at it’s intersection with I-285 in Dekalb County, Georgia. Clients vehicle was later declared a total loss. Client went by ambulance to Gwinnett Medical Center with complaints of neck pain, chest wall pain from the seatbelt, upper back pain and pain across his shoulders. Four days later, client began treatment with a chiropractor who ordered neck and lower back MRI’s which showed herniations at several levels with nerve impingement but also stated that the herniations were pre-existing but may have been exasperated due to the auto collision. Both the neck MRI and the low back MRI stated “it is medically probable that these are acute disc herniations superimposed on degenerative changes caused by the June 15, 2017 automobile collision”.
Injuries: Neck pain, mid back pain, low back pain, headaches, knee pain and chest pain. Client was treated by the chiropractor who referred client to a neurologist and a pain doctor where he received several cervical epidural steroid injections and underwent a cervical radiofrequency ablation procedure. His treating doctors recommended a posterior cervical decompression and fusion surgery at the C4-5 level but the client did not want to have any surgery nor has he undergone any surgery since the settlement of his case.
